Generally, you have 60 days from the date of the accident to report the incident to your employer. Failure to do so may impair your ability to receive benefits available to you under a workers’ compensation claim.
If your employer denies your workers’ compensation claim or no benefits are paid out to you, you must file a complaint with the industrial commission within one year of the incident or within one year from the date of the death of a worker.
If however, some benefits have been paid to you, you have five years to file a complaint with the industrial commission to seek indemnity benefits.
