Different parties will have different strategies to obtain the most workers’ comp benefits. However, under any circumstance, one cannot obtain double the benefit for the same occurrence.
For example, if an injured party receives both workers’ compensation and social security disability benefits, the total amount of benefits cannot exceed a certain amount per month.
The benefits received per month will be capped based upon the injured parties past earnings. Based upon those earnings, a number will be calculated to determine to maximum amount of benefits one may receive.
As such, the total combined workers’ comp benefits will not be able to exceed that calculated number.
