Unlike physical injuries which may be more easily proven, COVID may be difficult to establish since the virus can theoretically be contracted anywhere.
There has also been recent legislation which provides business owners with some immunity from COVID claims.
Absent a finding that the business acted recklessly in taking measures to prevent and minimize COVID within the work place, it may be difficult to establish this prerequisite.
